LU’S WIGS TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Lu’s Wigs website and your purchase of products or services from Lu’s Wigs (“Lu’s Wigs,” “we,” “us,” or “our”).

By placing an order, purchasing a product or service, booking a consultation or other paid service where these Terms are presented, or otherwise using our website, you agree to these Terms and the policies incorporated into them, including our Return & Refund Policy, Shipping Policy, Privacy Policy, Mobile Messaging Terms, and any product-, promotion-, wholesale-, resale-, consultation-, or service-specific terms presented to you.

Please review these Terms and applicable policies before completing a transaction.

1. PRODUCTS AND PRODUCT INFORMATION

Lu’s Wigs sells wigs, toppers, hairpieces, accessories, and related products and services.

We make reasonable efforts to accurately photograph, measure, describe, and represent our products. However, colors and appearance may vary based on lighting, photography, cameras, device settings, screen displays, surrounding colors, and other factors.

Human Hair and Hand-Finished Products

Many of our products are made with natural human hair and may be individually colored, rooted, highlighted, toned, cut, styled, ventilated, or otherwise hand-finished.

Because human hair is a natural material and many pieces are individually finished, reasonable variation may occur in characteristics including:

• color and tone;
• highlights, lowlights, and rooting;
• texture and movement;
• wave or curl pattern;
• density and hair distribution;
• length;
• hairline and knot appearance; and
• other characteristics inherent to natural or hand-finished hair products.

Minor variations of this nature do not necessarily constitute a defect.

When a listing expressly states that the customer is purchasing the exact piece shown, we will use reasonable efforts to accurately photograph and describe that particular piece.

Nothing in this section limits rights that cannot legally be waived.

2. SIZING, MEASUREMENTS, AND FIT

Customers are responsible for reviewing product measurements, cap construction, sizing information, and specifications before purchasing.

Measurements are approximate unless expressly stated otherwise.

Cap measurements are guidelines. Fit may vary based on head shape, individual anatomy, the amount and placement of biological hair, cap construction, and personal comfort preferences.

Two customers with the same circumference measurement may experience a different fit.

Any sizing recommendation, consultation, fitting assistance, or measurement guidance provided by Lu’s Wigs is intended to assist the customer in making a purchasing decision and is not a guarantee that a particular product will fit according to the customer’s personal preference.

3. ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase.

An automated order confirmation confirms that we received your order. It does not prevent us from correcting or canceling an order when reasonably necessary.

To the extent permitted by law, Lu’s Wigs may decline or cancel an order because of circumstances including:

• inventory or availability errors;
• an obvious pricing or listing error;
• inability to process or verify payment;
• suspected fraud or unauthorized payment;
• incorrect or incomplete order information;
• misuse of a promotion, discount, wholesale account, gift card, or store credit;
• a product becoming unavailable;
• duplicate or clearly erroneous orders;
• a technical or system error; or
• another circumstance that reasonably prevents us from fulfilling the order.

If Lu’s Wigs cancels a paid order or item, we will refund the amount paid for the canceled order or item unless you agree to another resolution.

4. PRICES, SALES, PROMOTIONS, AND DISCOUNTS

Prices may change without notice.

The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors as permitted by law.

Sales, promotional offers, discount codes, wholesale pricing, store credit, gift cards, and other offers may be subject to separate terms or exclusions.

Unless expressly stated otherwise, discounts and promotions may not be combined.

A wholesale discount, promotional code, or other discount may not be applied to merchandise excluded under the applicable offer, including sale merchandise when the promotion or wholesale program excludes already-discounted products.

If a discount is applied contrary to the disclosed terms of an offer, we may correct or cancel the affected order and refund any amount charged for canceled merchandise.

5. PAYMENT

You represent that you are authorized to use the payment method submitted with your order and that the billing information you provide is accurate.

Orders may be canceled or held when payment cannot be processed or reasonably verified.

Fraudulent, unauthorized, or intentionally misleading payment activity may result in cancellation of the transaction and refusal of future orders.

6. GIFT CARDS AND STORE CREDIT

Gift cards and store credit may be subject to additional terms presented when issued or purchased.

Unless otherwise required by law:

• store credit has no cash value and is not redeemable for cash;
• refunds for purchases made using store credit may be returned to store credit;
• promotional or courtesy credit may be subject to different terms from purchased gift cards;
• store credit may be restricted to use by the person or account to whom it was issued where disclosed at issuance; and
• Lu’s Wigs is not responsible for unauthorized use of a gift card or store-credit code after it has been delivered to the intended recipient, except where required by law.

Expiration dates or other restrictions will apply only to the extent permitted by applicable law.

7. PRE-ORDERS, SPECIAL ORDERS, AND ESTIMATED AVAILABILITY

Certain products may be offered as pre-orders, special orders, incoming inventory, or products with an estimated completion or availability date.

Any estimated completion, arrival, or shipping timeframe is an estimate unless expressly stated to be guaranteed.

Pre-order or special-order products may be subject to additional cancellation, deposit, return, or final-sale terms that will be disclosed in connection with the transaction.

If a shipping delay occurs, Lu’s Wigs will provide any notice, consent opportunity, cancellation option, or refund required by applicable law.

A pre-order does not guarantee an exact production or arrival date unless expressly stated in writing.

8. CUSTOMIZATION AND SERVICES PERFORMED BY LU’S WIGS

At a customer’s request, Lu’s Wigs may offer services such as cutting, coloring, toning, rooting, styling, cap alteration, sizing modification, or other customization.

Because many customizations are irreversible, customized or altered merchandise may become Final Sale once the requested service has begun or been completed if that condition was disclosed before the service was performed.

Customers are responsible for reviewing and approving customization instructions before work begins.

Reasonable variation may occur when reproducing inspiration photographs, color references, or prior work because human hair, starting color, lighting, and individual pieces vary.

A customization request does not guarantee an identical reproduction of a reference image unless expressly agreed in writing.

Any additional customization-specific terms presented before the work begins are incorporated into these Terms.

9. CONSULTATIONS, APPOINTMENTS, AND DEPOSITS

Consultations and appointments may be subject to separate booking, cancellation, rescheduling, deposit, or no-show terms presented at the time of booking.

Unless expressly stated otherwise, booking a consultation does not reserve a particular wig, topper, color, style, or other inventory for the customer.

Inventory may remain available for sale before an appointment and may no longer be available at the time of the consultation.

A consultation deposit or fee will be applied, refunded, forfeited, or credited according to the terms disclosed when the appointment is booked.

10. TAXES, DUTIES, AND INTERNATIONAL ORDERS

Applicable sales taxes will be collected when required by law.

International customers are responsible for customs duties, import taxes, VAT, brokerage charges, and other charges imposed by the destination country unless Lu’s Wigs expressly states otherwise.

Lu’s Wigs does not control customs processing, customs delays, or government-imposed charges.

11. SHIPPING AND DELIVERY

Shipping and delivery timeframes displayed on our website are estimates unless expressly stated to be guaranteed.

We will process and ship orders consistent with applicable law and the shipping representations provided at the time of purchase.

If an order cannot be shipped within a timeframe that requires notice or consent under applicable law, Lu’s Wigs will provide the applicable option to consent to the delay or cancel the unshipped merchandise for a refund.

After a package has been transferred to the shipping carrier, estimated delivery dates may be affected by circumstances outside our reasonable control, including carrier delays, weather, transportation interruptions, customs processing, natural disasters, government action, and other external events.

Customers are responsible for providing an accurate and complete shipping address.

If an address supplied by the customer is incorrect or incomplete, the customer may be responsible for reasonable additional shipping costs caused by the error, to the extent permitted by law.

If a package is lost, damaged, or subject to a carrier or insurance claim, the customer agrees to reasonably cooperate with information or documentation needed to investigate or process the claim.

12. INSPECT YOUR PRODUCT BEFORE ALTERING IT

Customers should inspect their product promptly after delivery and before altering, wearing, or treating the product in a manner that could affect return eligibility.

If you believe you received an incorrect, damaged, or defective product, contact Lu’s Wigs promptly and follow the procedures in our Return & Refund Policy.

Any concern regarding condition, color, construction, sizing, or another return-related issue should be raised before:

• cutting the lace;
• cutting or altering the hair;
• coloring, bleaching, toning, or chemically processing the hair;
• applying adhesive, tape, glue, makeup, powders, sprays, oils, or other products;
• altering the cap or construction;
• washing the product where the Return Policy requires it to remain unwashed; or
• otherwise materially altering the product.

Alteration or use may affect return eligibility as explained in our Return & Refund Policy.

13. DAMAGED, INCORRECT, OR ALLEGEDLY DEFECTIVE PRODUCTS

If you believe a product arrived damaged, was incorrectly fulfilled, or contains a defect, contact Lu’s Wigs before altering the product.

We may reasonably request photographs, videos, packaging, order information, return of the product for inspection, or other information necessary to evaluate the claim.

A customer’s characterization of a product as defective does not by itself establish that a manufacturing or product defect exists.

Where appropriate, Lu’s Wigs may inspect the product and determine the remedy available under our policies and applicable law.

Normal human-hair variation, normal wear, damage caused after delivery, or dissatisfaction based solely on personal preference does not automatically constitute a product defect.

Nothing in this section limits a remedy required by applicable law.

14. RETURNS, REFUNDS, EXCHANGES, AND STORE CREDIT

All returns, refunds, exchanges, store credits, return shipping obligations, restocking fees, final-sale restrictions, and return-condition requirements are governed by the Lu’s Wigs Return & Refund Policy, which is incorporated into these Terms.

Customers are responsible for reviewing that policy before purchasing.

Returned merchandise may be inspected before a refund, exchange, or store credit is approved.

Lu’s Wigs may deny a return that does not satisfy the disclosed return conditions, including where merchandise has been worn, altered, damaged, contaminated, or otherwise returned in a condition inconsistent with the Return & Refund Policy.

Products identified as Final Sale are not eligible for return, refund, or exchange except where required by law.

An exception, accommodation, refund, or courtesy provided in one situation does not waive Lu’s Wigs’ right to enforce its policies in another transaction.

15. ALTERATIONS, COLORING, STYLING, AND THIRD-PARTY SERVICES

Human-hair products can be permanently affected by coloring, bleaching, toning, chemical processing, cutting, adhesives, excessive heat, improper care, or incompatible products.

Except to the extent required by law, Lu’s Wigs is not responsible for damage caused after delivery by the customer or a third party, including a hairstylist, salon, colorist, cosmetologist, installer, or other service provider.

This includes damage caused by:

• coloring, bleaching, or toning;
• chemical processing;
• cutting, thinning, or other alteration;
• adhesives, tapes, or removers;
• excessive or improper heat;
• incompatible hair or beauty products;
• improper washing or drying;
• improper care or storage; or
• modification of the lace, cap, clips, combs, straps, or other construction.

Unless expressly stated otherwise, a third-party stylist or service provider is not an employee, agent, or representative of Lu’s Wigs merely because the provider works on a Lu’s Wigs product or has been mentioned or recommended by us.

16. NORMAL WEAR, CARE, AND PRODUCT LIFESPAN

Wigs, toppers, and hairpieces are wearable products and experience wear over time.

Product longevity varies based on factors including frequency of wear, friction, environment, washing, styling, heat exposure, chemical processing, products used, maintenance, storage, and individual handling.

Unless Lu’s Wigs expressly provides a separate written warranty stating otherwise, we do not guarantee that a product will last for a specific number of months or years.

Changes such as some shedding, dryness, fading, tangling, texture changes, or other changes associated with wear do not automatically establish that a product was defective when sold.

Nothing in this section limits rights or warranties that applicable law does not permit us to exclude.

17. CONSULTATIONS AND PRODUCT RECOMMENDATIONS

Lu’s Wigs may provide sizing assistance, product recommendations, styling guidance, educational information, and other assistance.

Recommendations are based on the information available to us and are intended to help customers make purchasing decisions.

Because preferences vary, a recommendation does not guarantee that a customer will personally prefer a particular color, style, density, length, cap construction, texture, or fit.

Information provided by Lu’s Wigs regarding hair loss, wigs, or related subjects is for general informational purposes and is not medical diagnosis or treatment.

If a customer intends to seek reimbursement through insurance, an HSA, FSA, medical reimbursement program, tax deduction, or another benefit, the customer is responsible for determining eligibility with the appropriate insurer, plan administrator, tax professional, or other organization.

Providing a receipt or other purchase documentation does not guarantee reimbursement.

18. WHOLESALE AND AUTHORIZED RESALE

Products may not be purchased for commercial resale unless the purchaser has been expressly authorized by Lu’s Wigs under an approved wholesale, resale, or other commercial arrangement.

Authorized wholesale or resale transactions are additionally governed by the applicable wholesale or resale terms.

Wholesale discounts, pricing, return rights, sale exclusions, minimums, or other conditions may differ from those available to retail customers.

Lu’s Wigs may suspend or terminate wholesale or resale privileges for misuse of the program or violation of applicable terms.

19. PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact Lu’s Wigs promptly if they believe there is a problem with a transaction.

If a customer initiates a chargeback or other payment dispute, Lu’s Wigs may provide information reasonably relevant to that dispute to the payment processor, card issuer, bank, financial institution, insurer, or dispute administrator.

Relevant information may include:

• order records;
• payment records;
• product listings;
• shipping and tracking records;
• proof of delivery;
• checkout acknowledgments;
• applicable policies and Terms;
• customer communications;
• photographs;
• return inspection records; and
• other records relevant to the transaction.

Nothing in these Terms prevents a customer from exercising a chargeback or payment-dispute right that applicable law does not permit the customer to waive.

20. FRAUD, POLICY ABUSE, AND REFUSAL OF FUTURE BUSINESS

To the extent permitted by law, Lu’s Wigs may decline future business, restrict purchasing privileges, or cancel a transaction when we reasonably believe there has been:

• fraud or attempted fraud;
• unauthorized payment activity;
• intentional misrepresentation;
• misuse of promotions, discounts, wholesale privileges, store credit, or return policies;
• repeated abusive or fraudulent use of chargebacks or payment disputes;
• threats, harassment, or abusive conduct toward our staff or representatives;
• unauthorized commercial resale; or
• other unlawful or materially improper conduct.

Nothing in this section permits unlawful discrimination or limits rights protected by applicable law.

21. REVIEWS, PHOTOS, VIDEOS, AND CUSTOMER CONTENT

Customers are free to share honest opinions about Lu’s Wigs and our products or services.

If you voluntarily submit a review, photograph, video, testimonial, social-media submission, or other content to Lu’s Wigs for publication, marketing, reposting, testimonial, or promotional purposes, you represent that you have the right to provide that material.

You grant Lu’s Wigs a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, crop, format, distribute, and use content that you intentionally submit to us for those purposes in connection with our website, social media, advertising, email, and other business marketing.

You retain ownership of your content.

Lu’s Wigs may remove or decline to publish content that is fraudulent, unlawful, threatening, abusive, obscene, defamatory, infringing, contains another person’s private information, or otherwise violates applicable law or platform rules.

Nothing in these Terms prohibits or penalizes a customer for publishing an honest review.

22. LU’S WIGS CONTENT AND INTELLECTUAL PROPERTY

The Lu’s Wigs name, logos, photographs, videos, graphics, original written content, product photography, website content, designs, educational materials, and other protected materials are owned by or licensed to Lu’s Wigs.

Except where permitted by law or expressly authorized by Lu’s Wigs, our protected materials may not be copied, reproduced, republished, sold, scraped, redistributed, or commercially exploited.

Use of our photographs, product imagery, videos, or branding for unauthorized commercial listings, resale marketing, advertising, impersonation, or misrepresentation is prohibited.

23. THIRD-PARTY SERVICES AND LINKS

Our website may contain links to or integrate with independent third-party services, including payment providers, financing services, shipping carriers, booking platforms, social-media services, review platforms, stylists, or other businesses.

Except where applicable law provides otherwise, Lu’s Wigs is not responsible for the independent products, services, representations, privacy practices, policies, availability, or conduct of third parties outside our control.

A link, integration, mention, or recommendation does not necessarily constitute a guarantee or warranty of the third party’s services.

24. EMAIL AND MOBILE MESSAGING

Lu’s Wigs may communicate with customers by email, SMS, MMS, RCS, or other electronic messaging methods for transactional, customer-service, and marketing purposes as permitted by applicable law.

Transactional Communications

When you provide an email address or telephone number in connection with an order, consultation, return, shipping matter, or customer-service request, Lu’s Wigs may use that information to send communications reasonably related to that transaction or request.

These may include order confirmations, shipping updates, delivery information, appointment information, return communications, customer-service messages, and other legally permitted non-marketing communications.

Marketing Emails

If you subscribe to Lu’s Wigs marketing emails, you may receive promotional communications, product announcements, sales information, educational content, and other marketing messages.

You may unsubscribe from marketing emails using the unsubscribe method provided in those communications.

Unsubscribing from marketing emails does not prevent us from sending transactional or legally required communications regarding an order or existing relationship.

SMS, MMS, RCS, and Mobile Marketing

If you affirmatively enroll in a Lu’s Wigs mobile marketing program, you may receive recurring automated or non-automated marketing and promotional messages at the telephone number you provide.

Messages may concern products, promotions, abandoned carts or checkouts, product availability, reviews, and other Lu’s Wigs marketing.

Consent to receive marketing text messages is not a condition of purchasing a product or service from Lu’s Wigs.

Message frequency may vary. Message and data rates imposed by your wireless carrier may apply.

By enrolling, you represent that you are the subscriber or customary user of the telephone number provided or are otherwise authorized to consent to receive messages at that number.

You may revoke consent to receive marketing messages at any time by replying STOP or by using another reasonable method that clearly communicates your request to stop receiving marketing messages.

Lu’s Wigs will process valid opt-out requests in accordance with applicable law.

Where permitted, we may send a one-time message confirming an opt-out request.

Opting out of marketing messages does not prevent Lu’s Wigs from sending non-marketing communications that are legally permitted or necessary in connection with an order, transaction, customer-service matter, or other separately authorized communication.

Participation in a Lu’s Wigs mobile messaging program is also governed by our Mobile Messaging Terms and Privacy Policy.

If the Mobile Messaging Terms conflict with these general Terms regarding the mobile messaging program, the Mobile Messaging Terms control with respect to that program.

25. PRIVACY

Our collection, use, disclosure, and handling of personal information are governed by the Lu’s Wigs Privacy Policy, which is incorporated into these Terms by reference.

26. WEBSITE ACCESSIBILITY

Lu’s Wigs is committed to providing customers, including customers with disabilities, access to our website, products, and services.

If you experience difficulty accessing information, completing a transaction, or using a feature of our website, please contact us at support@luswigs.com so that we can assist you and review the issue.

Additional information regarding our accessibility efforts may be provided in our Accessibility Statement.

Nothing in these Terms waives or limits rights available under applicable disability law.

27. ERRORS AND INACCURACIES

Despite reasonable efforts to maintain accurate information, errors may occasionally occur in pricing, product descriptions, measurements, promotions, availability, specifications, images, or other website information.

To the extent permitted by law, Lu’s Wigs may correct an error, update information, or cancel an affected order.

If we cancel an order after collecting payment because of such an error, we will refund the amount paid for the canceled merchandise.

28. WARRANTIES

Nothing in these Terms excludes a warranty or consumer right that applicable law does not permit Lu’s Wigs to exclude.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT FOR A WARRANTY EXPRESSLY PROVIDED BY LU’S WIGS IN WRITING, PRODUCTS AND SERVICES ARE PROVIDED “AS IS.”

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LU’S WIGS DISCLAIMS IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Where applicable law does not permit a particular warranty to be excluded, this provision applies only to the maximum extent permitted by law.

29. LIMITATION OF LIABILITY

PLEASE READ THIS SECTION CAREFULLY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LU’S WIGS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF USE, OR SIMILAR CONSEQUENTIAL LOSSES ARISING OUT OF OR RELATING TO A PRODUCT, ORDER, TRANSACTION, OR USE OF OUR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LU’S WIGS ARISING OUT OF OR RELATING TO A PARTICULAR PRODUCT, ORDER, OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO LU’S WIGS FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations apply regardless of whether a claim is asserted under contract, warranty, negligence, tort, statute, or another legal theory, except where applicable law prohibits such a limitation.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, personal injury where applicable law prohibits such a limitation, or any other liability that cannot legally be excluded or limited.

30. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold Lu’s Wigs harmless from third-party claims, liabilities, losses, damages, and reasonable costs arising directly from:

• your unlawful use of our website or services;
• your material violation of these Terms;
• your infringement or misuse of another person’s intellectual property, privacy, or other legal rights;
• content you submit when you did not have the right to submit or authorize its use; or
• fraudulent or unlawful conduct by you involving our Services.

This provision does not require you to indemnify Lu’s Wigs for liability caused solely by Lu’s Wigs where such indemnification is prohibited by law.

31. GOVERNING LAW AND VENUE

These Terms and transactions with Lu’s Wigs are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where federal law applies or another applicable law cannot legally be waived.

To the extent a dispute may properly be brought in court, the parties agree to jurisdiction and venue in the appropriate state or federal court serving Jackson County, Georgia, except where applicable law requires otherwise.

32. GOOD-FAITH DISPUTE RESOLUTION

Before commencing formal legal proceedings concerning a purchase, the customer and Lu’s Wigs agree, where reasonably possible, to first make a good-faith effort to resolve the issue directly.

Nothing in this section prevents either party from taking action necessary to preserve a legal right, comply with a legal deadline, seek emergency relief, or exercise a right that cannot legally be restricted.

33. POLICIES INCORPORATED INTO THESE TERMS

• Privacy Policy;
• Mobile Messaging Terms;
• Accessibility Statement;
• wholesale terms;
• gift card and store-credit terms;
• promotion-specific terms;
• pre-order or special-order terms;
• customization terms;
• consultation and booking terms;
• final-sale terms;
• resale or trade-in program terms; and
• other product- or service-specific terms expressly presented in connection with a transaction.

Where specific written terms for a product, promotion, program, or service conflict with these general Terms, the more specific terms govern that transaction or program to the extent permitted by law.

34. CHANGES TO THESE TERMS

Lu’s Wigs may update these Terms from time to time.

The current version will be posted on our website with the applicable effective date.

Where applicable law requires notice or additional consent for a material change, we will provide it.

A later change to these Terms will not retroactively remove a right associated with an earlier transaction where applicable law does not permit us to do so.

35. SEVERABILITY AND NO WAIVER

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

If Lu’s Wigs chooses not to enforce a provision in one instance, that does not waive our right to enforce the same or another provision in the future.
